I. Overview

The following terms and conditions are to describe the agreement for participation in Pilates instruction between Katherine LaPlant (hereafter referred to by name, as the “Trainer” or as the “Studio”) and any participant (hereafter referred to as a “participant” or the “Client”)

II. Conditions of participation

New clients must complete the New Client Intake Form and sign the Liability Release Form prior to the start of their first session. It is necessary to make the Trainer aware of any information relevant to their physical health and/or medical history that may affect their ability to participate in Pilates instruction. It is the responsibility of the Client to inform the Trainer of any relevant changes to their physical and mental health throughout the course of their working relationship. The Trainer reserves the right to request medical clearance from the Client’s healthcare providers as deemed appropriate. 

Clients are requested to attend sessions only if they are in good health. The Trainer reserves the right to terminate a session at any time if they suspect the Client is unwell. 

III. Registration / Credit Usage

Participation in any type of Pilates class with the Trainer requires a binding registration. This registration can be made with the Trainer either in person, by phone, via SMS or other digital messaging application, online via www.practicepilatesberlin.com, or by email. 

This registration becomes effective once confirmed by the Trainer, or is effective immediately if booked via the website. Once confirmed, this registration is binding. The session’s fee must be paid in full by the session’s start time. If a confirmed session must be cancelled by the Client, it must be done at least 12 hours before the session’s start time. If a confirmed session must be cancelled less than 12 hours before the session’s start time, the Trainer will retain 100% of the session’s fee. If a confirmed session must be cancelled by the Trainer (either 12 hours before the session’s start time or otherwise) the session’s fee will remain in the Client’s account as a valid and bookable credit. If a confirmed session must be cancelled by the Trainer, and the Client’s credit is imminently due to expire, the validity of the credit may be extended to accommodate a rescheduling of the cancelled session. 

The following terms apply to session credits and packages:

Single session credits remain valid for 90 days. Session credits from a five session series remain valid for 90 days. Session credits from a ten session series remain valid for 90 days. Sessions from the introductory offer remain valid for 30 days. Virtual Session credits remain valid for 90 days. Single extended session credits remain valid for 90 days. 

IV. Terms of payment

Prices do not include VAT as the Trainer is not required to collect this. The Trainer reserves the right to modify or update session and/or service fees at any time for any reason.  

Payment can be made online via www.practicepilatesberlin.com, with cash, or by bank transfer. 

Refunds may be granted on a case-by-case basis and will incur a 10 EUR service fee. 

V. Assumption of risk / Release of Liability

By booking a session, the client acknowledges that participation in any form of exercise (whether in-studio, at home, or virtually) with the Trainer may involve risks, including risk of personal injury.  By booking a session, the client furthermore acknowledges that to engage in any exercise, or use any equipment for any purpose, is to be done at their own risk and that they assume the risk of any and all injury and/or damage that may be suffered, whether while engaging in physical exercise or not. This includes injury or damage sustained while and/or resulting from using any equipment, whether provided by the Trainer or otherwise.

By booking a session, the Client acknowledges that the Trainer may use tactile cueing and adjustment methods, or make physical contact with the Client for correction purposes in order to ensure that the session is undertaken in accordance with the Trainer’s safety protocols and best intentions. By booking a session, the Client agrees that they are voluntarily participating in the aforementioned activities and assume all risk of injury, illness, damage, or loss to themself or their property.

The Trainer is not medically trained and is therefore not qualified to assess whether the Client is in good physical condition and/or that the Client is able to engage in exercise without detriment to their health, safety, comfort and/or physical condition. Participants are advised to seek medical advice prior to commencing any exercise program if they are in any doubt about their ability to engage in such activities.

VI. Data protection

Information collected by the Trainer is confidential and will not be passed on to any other parties without consent from the Client. 

All clients are requested to fill out a New Client Intake Form which intends to collect relevant information about each client’s health and medical history. This information is stored securely and will not be shared with anyone. 

All payments via the Trainer’s website are processed by Stripe. The Studio may collect personal data such as (but not limited to) the IP address of the Client’s device used when processing a payment, the last four digits of a Client’s credit card number, the Client’s email address, and/ or mailing address associate with their payment method. The Trainer’s website is hosted by Squarespace. The Studio may collect personal data such as (but not limited to) the IP address of the Client’s device used when visiting www.practicepilatesberlin.com, as well as personal and contact information in the event that a session is booked. VII. Governing Law 

The aforementioned terms and conditions are to be interpreted and applied as under law in the Federal Republic of Germany.
